These Terms of Service govern the use of services provided by FireFly Stack LLC. By accessing or using our platform, services, or websites, you agree to these Terms.
1. Services Provided
FireFly Stack LLC provides: Website development, Hosting management, Software development, Subscription-based web services, Technical consulting, Internal business tools, and AI-assisted software solutions. Services may evolve over time.
2. User Accounts
Users are responsible for maintaining account security, keeping credentials confidential, providing accurate information, and compliance with applicable laws. FireFly Stack reserves the right to suspend or terminate accounts that violate these terms.
3. Payments and Subscriptions
Subscriptions are billed monthly or annually, depending on the billing cycle you select at checkout, and renew automatically at the end of each period until canceled. Payments are processed securely through Stripe. Failed payments may result in service interruption, website suspension, or account restrictions. Refund eligibility is determined on a case-by-case basis.
4. Website Ownership
Unless otherwise agreed in writing: Clients own their business content. FireFly Stack retains rights to proprietary systems, frameworks, templates, and platform infrastructure. Third-party services remain governed by their respective licenses.
5. Acceptable Use
Users may not: Upload malicious content, violate laws or regulations, attempt unauthorized access, abuse platform resources, distribute malware, or use the platform for fraudulent activity.
6. Privacy
FireFly Stack values user privacy. We implement industry-standard safeguards to protect user data. Users acknowledge that no system can guarantee 100% security.
7. Third-Party Services
The platform may integrate with Stripe, Supabase, GitHub, Cloudflare, and Google. Users are also subject to those providers' terms where applicable.
8. Limitation of Liability
FireFly Stack LLC shall not be liable for indirect damages, loss of revenue, loss of data, business interruption, or third-party outages. Maximum liability shall not exceed the amount paid by the customer within the prior three months.
9. Service Availability
We aim for high uptime but do not guarantee uninterrupted service. Maintenance, updates, or outages may occasionally occur.
10. Termination
We reserve the right to terminate services for violation of terms, illegal activities, abuse of the platform, or non-payment. Users may terminate services according to their subscription agreement.
11. Intellectual Property
All proprietary software, branding, systems, workflows, and platform infrastructure created by FireFly Stack LLC remain protected intellectual property unless otherwise agreed.
12. Modifications
These Terms may be updated periodically. Continued use of the platform constitutes acceptance of updated Terms.
13. Governing Law
These Terms shall be governed under the laws of the State of Utah, United States.
